5. The position of the Court of Appeal is the law. However, instead of supporting staff in individual legal matters, NHS unions strongly support a negotiated deal. This option is also preferred by trusted leaders. Both parties are aware of the legal costs and resources to employees and employers arising from supporting or defending individual members` legal claims. The East of England Ambulance Service NHS Trust currently has an appeal pending before the Supreme Court to overturn the Court of Appeal`s decision. The case is expected to be heard in June 2021, and it is important to note that the decision could change the legal situation. The NHS Staff Council has agreed on a framework that will enable NHS employers in England to resolve issues related to the correct calculation of pay during annual leave in relation to regular overtime and normal overtime (AST) in line with the NHS Terms of Use Change Programme. Calculations are based on overtime and normal overtime pay paid in the last two fiscal years (April 1, 2019 to March 31, 2020 and/or April 1, 2020 to March 31, 2021) for work performed under the hardware contract. 6. Is the wage for anti-social working hours included in this framework agreement? Does this take precedence over local agreements to address historical problems with the calculation of salaries for annual leave and overtime pay outside of the above deadlines? The framework agreement provides for corrections only for the financial years 2019-2020 and 2020-2021. An eligible employee may receive a correction payment for one or both fiscal years, as described in the «Eligibility FAQs» section below. Allowances are based on overtime worked during the 2019/2020 and 2020/2021 financial years. To be entitled to a correction payment in one or both financial years, an employee must meet the eligibility criteria set out in the framework agreement. This Agreement applies only to England. An agreement has already been reached in Scotland. Employers in Cyprus, Wales and Northern Ireland have indicated that they will enter into discussions with trade unions to resolve the issue. 18. The framework agreement aims to reach an agreement on corrections for eligible staff in partnership with the trade unions, which is fair for staff and taxpayers. All entitlements to underpaid vacation pay in relation to overtime pay until 31 March 2021 shall be resolved and corrected by the provisions of this Framework Agreement and shall not be prosecuted.

While various commitments have been made on the ground before 1 April 2019, NHS employers will have to work with trade unions to decide how the commitment will be met. 12. What about periods prior to April 1, 2019? Are employees entitled to correction payments for these fees? 57. All parties to the Framework Agreement agree that it is essential to set a ceiling for those to whom the Framework Agreement and the corrections apply. This alone requires the identification of the limits of those entitled to corrections.
